Managing Partner of VLawyers Law Firm, Natalia Dvenadtsatova, commented for the publication Pravo.ru on the position of the Supreme Court of the Russian Federation regarding the subordination of claims of the commercial bank "Legion" in the bankruptcy case of OOO "Molos".
Natalia gave her assessment of the emerging practice concerning the possibility of subordinating claims of banks that refinance loans of debtors in a pre-bankruptcy state.
According to Natalia:
"The Supreme Court of the Russian Federation rightly pointed out that a civil law transaction to refinance loans under conditions of affiliation between the parties, but without evidence of a beneficial interest on the part of the bank in relation to the debtor, is not grounds for subordination."
