During the discussion, Natalia assessed the possibilities of using bankruptcy tools, including subsidiary liability, to resolve corporate conflicts.
"Sometimes during a company's bankruptcy, former business partners try to get access to each other's assets through subsidiary liability. However, currently the Supreme Court of the Russian Federation believes that creditors affiliated with the debtor cannot use 'subsidiary liability.' This trend emerged in the case of OOO 'Egorye' (Case No. А23-6235/2015). The Supreme Court of the Russian Federation then decided that subsidiary liability cannot be used as a weapon in corporate disputes,"

Natalia shared with the conference participants her own successful experience in combating claims by affiliated creditors seeking to hold controlling persons subsidiary liable, as well as her practice of proving the actual affiliation between a creditor and a debtor by analyzing information posted on their social media.
